Train of Thought Privacy Policy

- This policy applies to all services offered by Train of Thought Fitness Inc. (“Train of Thought”), including all associated applications, and governs data collection and usage. At Train of Thought, the security and integrity of our customers’ personal information is important to us. We take every reasonable measure necessary to protect the privacy of our customers while providing the high-level communication services they expect. By using any Train of Thought services, you consent to the data practices described in this statement.
- Train of Thought’s privacy practices, and those of all the individual services Train of Thought provides improve their health and fitness through physical training and nutritional education. are in accordance with all federal and provincial laws and regulations. We are compliant with the Personal Information Protection Act (British Columbia) and the federal Personal Information Protection and Electronic Documents Act (PIPEDA).
- Train of Thought has privacy and security practices in place to safeguard our customers’ personal information. These practices are reviewed, and if necessary revised, on a regular basis. Additionally, Train of Thought’s employees receive privacy training and must comply with Train of Thought’s privacy practices as a condition of employment.
- Personal information collected by Train of Thought is information about an identifiable individual that may include such information as your name, email address, mailing address, phone number, financial information, birth date, credit card information, related account information and any recorded complaints. Any of the above personal information will only be collected if and when the user chooses to create a user account with Train of Thought. Train of Thought will store the information collected securely, and only for as long as is necessary to provide the services requested, or until you request the deletion of your account.
- Train of Thought does not use or disclose sensitive personal information, such as race, religion, political affiliations or sexual preference without your explicit consent.
- Unless you create a User account, while using our website, Train of Thought does not collect information regarding you and your use of our service, or your interactions with us, except information that is strictly necessary for the functionality of the website, including device IDs or unique identifiers, device and software characteristics (such as type and configuration), connection information, statistics on page views, referral URLs, IP address and standard web log information.
- If you create a User account or interact with customer service, Train of Thought does retain user details regarding your interactions with customer service, such as the date, time and reason for contacting us, transcripts of any chat conversations and, if you call us, your phone number for as long as is necessary to resolve the issue for which you contacted Train of Thought.
- Train of Thought may use other companies, agents or contractors (“Service Providers”) to perform services on our behalf or to assist us with the provision of services to you. For example, we may engage Service Providers to process credit card transactions or other payment methods, and to provide customer service. In the course of providing such services, these Service Providers may have access to your personal or other information. Train of Thought does not authorize them to use or disclose your personal information except in connection with providing their services. Train of Thought does not knowingly collect or maintain any personal information from anyone under the age of majority on the service. By registering and using the service, the user warrants that they have reached the age of majority in their province, territory or jurisdiction, or is accessing the service with parental consent. If an individual under the age of majority in their province, territory or jurisdiction is found to have registered by falsely claiming to be the appropriate age during registration, Train of Thought will delete the account and will remove and/or delete any personal information that may have been submitted by that individual.
- Train of Thought does not use or disclose personal information for purposes other than those for which it was collected, except with the consent of the individual or as required by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Train of Thought or the site; (b) protect and defend the rights or property of Train of Thought; and, (c) act under exigent circumstances to protect the personal safety of users of Train of Thought, or the public. Train of Thought retains personal information only as long as necessary for the fulfillment of those purposes. If your account is cancelled, Train of Thought will retain your personal information for 24 months, or such other period as required by law, and will then delete it.
- Train of Thought informs customers of the existence, use and disclosure of their personal information upon request and gives them access to their information.
- Train of Thought ensures that customer information is accurate, complete and up-to-date. Customers can challenge the accuracy and completeness of the information and request amendments as appropriate.
- A company officer has been appointed as the Privacy Officer at Train of Thought. The Privacy Officer is accountable for all personal information at Train of Thought. - If you choose to use any Train of Thought services, your use of the same and any dispute over privacy is subject to this Privacy Policy and our Terms of Use, including limitations on damages, resolution of disputes, and application of the law of the Province of British Columbia, Canada. Our business changes constantly, and our Privacy Policy and the Terms of Use will change also. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our website frequently to see recent changes. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.
